Back again.

Wow, that week break went by really fast. I'm back in class today, starting off my new semester with an enthralling federal income tax class. Yea. Here are my classes:
Constitutional Law -- Professor Fink
Content:  This course surveys the basic “structural” issues in constitutional law, including the separation of powers

between the legislature, executive, and judicial branches of government.  We will focus in particular on the role of the

Supreme Court and lower federal courts in defining the distribution of power among these branches of government.

Federal Income Tax -- Professor Schwidetzky

Content:  This course examines Federal Income Taxation of the individual.  It includes the basic principles of the federal

income tax, including the concepts of gross income, exclusions, deductions, capital gains and losses, gains and losses

from trade or business property, like kind exchanges, and the alternative minimum tax.  Tax concepts and theory as well

as practical application are covered.

Trusts & Estates -- Professor Schwidetzky

Content:  This course examines the gratuitous disposition of property, including transfers under (1) intestate statutes; (2)

wills, including the formalities of execution, testamentary capacity, undue influence, and fraud; (3) will substitutes, such

as gifts and joint tenancies; (4) trusts, including methods of creation and termination, rights and interests of beneficiaries,

and special problems relating to resulting, constructive, and charitable trusts.  In addition, the course will examine the

growing body of law relating to the termination of medical treatment and health care powers of attorney.

Pretrial Practice -- Judge Stiven

Content:  A practical course designed to familiarize students with three aspects of pre-trial practice: discovery; motion

practice; and trial preparation.  The course will be a combination of lecture, discussion/case analysis and practical

exercises.  Students will be given the opportunity to write discovery requests and responses, take a deposition and prepare

and argue pre-trial motions. The course will emphasize developing both written and oral advocacy skills as well as

practical application of those skills to actual litigation practice.  There will, of course, be focus on the applicable statutes

and rules governing discovery and motion practice, with an emphasis on the Federal Rules of Civil Procedure.  Written

work, classroom participation and performance in exercises will all be considered in grading.  There will be no final

exam.

STEPPS -- Ryan Williams Esq.

Content:  The STEPPS course (Skills Training for Ethical and Preventive Practice and career Satisfaction) integrates the study of

Professional Responsibility, Advanced Legal Research and Writing, Lawyering Skills, and Problem Solving/Preventive

Law.  As the title of the course suggests, it also examines issues of career satisfaction.

Finals finally over.

I finished my last final of this semester this past Wednesday. My school does a good job of predicting the difficulty of each exam and ordered them from least difficult to most difficult. I think they were right. My last exam was business organizations, which is a four hour class (compared to a three hour class) and also allows the professor to use four hours for the exam rather than the usual three. My professor did exactly that and I was waist deep in exam material from 8:00 am to noon. Long exam. It helped that I enjoyed the class. The material itself has grown in importance in the past decade. Not only has there been a lot of new rules and precautions taken because of the Enron debacle, but the growing popularity of LLCs and LLPs have brought new statutory material all across the board. My professor said that the last bar tested on LLCs for the first time last time and she might start doing that soon. Well, that's exactly what she did. The exam started with two entrepreneurs, coming together to form an LLC, who entered into a contract and a loan that were contested, a bank bringing a defaulted loan claim and a plaintiff bringing a "piercing the corporate veil" claim, afterwards they filed their articles of incorporation to become a closely held corporation, board member meeting required both procedure and substantive analysis with interested directors, then the corporation went public with an ensuing shareholder suit for an alleged Securities Act 10b-5 fraud, and finishing with an insider trading issue. Yeah, it was a lot of material. Thankfully I felt like I knew it all, my hard work all semester paying off. Now I finally get to spend time with Shandie-pants which makes me happy. -Dave

Law Widow Update

Dave has been extremely busy with finals the last couple of weeks so as you can imagine it's been pretty uneventful for us at home. I really have been a "law widow". He has his last final on Wednesday and we are planning on spending some relaxing quality time together after that. I'm really proud of him and I know he will do well.

Work has been going well. The HR department there does a "You Rock" raffle. Managers hand out "You Rock" slips to employees when they feel like they have gone the extra mile with something. Every month there is a drawing and I won the raffle for the month of July. They gave me a $100 Target gift card and a "You Rock" pin (Hard Rock is really in to their pins). Can you believe that next month will mark my 1 year anniversary working there? Time is flying.

During Dave's break from school we are going to take a sushi class at a restaurant in Balboa Park. I'm pretty excited because as you may know Dave and I LOVE sushi.

Well, I just wanted to write some kind of an update even though there isn't much to update. I will make sure to take pictures during Dave's break and I will post them next week. Hope all is well!

PS... My brother and my mom suggested a book to me called "The Mastery Of Love" by Don Miguel Ruiz. It was a good book. I recommend it.

PSS... The hummingbird flew around the feeder but never actually made contact with it.

HUMMINGBIRD WATCH!

A couple of weeks ago I was sitting on the couch when I looked out the window and noticed a hummingbird flying around our outdoor hanging plant. Ever since then I decided that we needed to buy a hummingbird feeder.
So far the hummingbird bird has not been back.

Working out.

Well, two things have motivated me to start working out again. First, Shandie has been working out and she's looking great. Second, my lack of physical activity has started to affect my sleep and it slows down my brain during the day. So I went downstairs to our gym (which is air conditioned and on the lobby level of our building, very convenient) and did a "light" workout. It is now 3 days later and I'm still having difficulty straightening out my arms. I am so sore! All this time I thought sitting and typing all day was sufficient physical activity. BUT, I feel better and I'm sleeping better which is exactly what I need to feel physically ready for finals next week. -Dave

Fundraiser At Work

On Wednesday night we went to a breast cancer fundraiser at my work (Hard Rockers Help Save The Knockers). It was a lot of fun to take Dave to the hotel and introduce him to some of the people I work with. There was bingo, raffle prizes, food and stand-up comedians. We won 2 raffle prizes: a gift certificate to Pinkberry and one to Rockin' Baja Lobster. (Pinkberry just opened in the hotel about a month ago. Although it is pretty tasty, I don't get as excited about it as everyone else in California seems to. People went crazy for it when it opened. To me it was like Cafe Rio in Utah. I just don't get the big deal.) I really wanted to win the stay at the Hard Rock Hotel Las Vegas but so did everyone else. Either way, it was a great cause and a really good time.

Update

A long time ago I mentioned that I needed to get in shape. Well, guess what? I have lost 18 pounds since March! Only 12 more to go until I reach my goal. This is a huge accomplishment for me and I'm really excited.

Hope all is well.
